Smithfield Loses Fourth Case Alleging Nuisance


On Wednesday December 12th, jurors in Raleigh awarded compensation to neighbors of the Sholar Hog Farm contracted to Smithfield foods.  Previously three related cases were decided in favor of neighbors with both compensatory and punitive damages.  U.S. District Judge David Faber determined that there was insufficient justification for punitive damages in this case. 


Smithfield Foods has recognized the magnitude of opposition to disposal of waste using lagoons and spray application to pasture.  Earlier in December the Company announced a joint venture to install biodigesters that would generate methane from hog waste to be used as a fuel.
